General Terms and Conditions for Property Management

The General Terms and Conditions for Property Management regulate the relationship between the property manager (company or person entrusted with the management of property) and the owner of the property (Principal). These Terms and Conditions cover all relevant aspects related to the provision of management services, from maintenance and rent payment to reporting and responsibility for the property.

1. INTRODUCTORY PROVISIONS

1.1. These General Terms and Conditions (“Terms”) apply to the property management services provided by Plan B or another company providing similar services.
1.2. The property management contract is concluded between the property manager (hereinafter: “Manager”) and the owner of the property (hereinafter: “Owner”). 
1.3. These Terms and Conditions apply to all activities related to the management of property, which include maintenance, rental, rent payments and the provision of other services defined in the contract.

2. DEFINITIONS

2.1. Manager: A natural or legal person who is appointed to manage a property on behalf of the owner.
2.2. Owner: A natural or legal person who is the owner of a property and who appoints the manager to carry out the management tasks for his benefit.

3. OBLIGATIONS OF THE MANAGER

3.1. Property management: The manager undertakes to take all necessary actions to manage the property, including but not limited to:

a) Organizing and carrying out necessary repairs and maintenance on the property.
b) Ensuring the proper operation of all installations and systems in the property (water, sewage, electricity, heating, etc.).
c) Keeping records of tenants, landlords, users and maintaining all necessary documents.
d) Facilitating communication between the owner and users/tenants.
e) Ensuring compliance with legal norms and local regulations related to the maintenance and use of the property.

3.2. Rent collection:

a) The Manager assumes responsibility for collecting rents as well as any other claims from the users of the property (if applicable).
b) The Manager provides the Owner with monthly reports on payments received and the payment status of the users.

3.3. Reporting:

a)The Manager is obliged to regularly inform the Owner about all activities related to the management of the property, including repairs carried out, the condition of the property, rent payments and other relevant information.
b) The Manager will provide the Owner with quarterly or annual financial reports.

3.4. Insurance and protection of the property: The manager is obliged to take appropriate measures to protect the property from damage and to provide the owner

4. OBVEZE VLASNIKA

4.1 Providing the conditions for management: The owner is obliged to provide the manager with unhindered access to the property and all necessary information so that the manager can perform his duties.

4.2. Payment of the management fee: The owner undertakes to pay the manager the management fee in accordance with the conditions set out in the contract.

4.3. Responsibility for the property: The owner is responsible for the essential obligations related to the ownership of the property, including insuring the property, paying property taxes and complying with local legal regulations.

4.4. Notification of the manager: The owner is obliged to inform the manager of any changes related to the status of the property, landlords or other relevant information.

5. COMPENSATION AND PAYMENT

5.1. Management fee: The fee for the management services is specified in the contract between the owner and the manager.

a) The fee may be a fixed monthly fee, a percentage of the rental income or a combination of both options.
b) If the fee is a percentage of the rent, it is usually calculated based on the monthly rental amount.
c) The fee may also include other services (repairs, cleaning, insurance) that are specifically indicated and agreed

5.2. Method of payment: The owner will pay the fee according to the terms specified in the contract, usually monthly or based on the payment modalities provided for in the contract.

6. DURATION OF THE CONTRACT AND TERMINATION

6.1. Duration of the contract: The property management contract may be concluded for an indefinite or fixed period, depending on the agreement between the parties.
6.2. Termination of the contract:

a) Either party may terminate the contract after prior notice to the other party in accordance with the terms of the contract.
b) Termination of the Agreement may be possible if one party seriously breaches its essential obligations towards the other party.
c) Termination of the Agreement will not affect payments due up to the time of termination.

7. DISPUTE SETTLEMENT

7.1. Disputes: Should any disagreement or dispute arise in connection with this Agreement, the parties will attempt to resolve the dispute amicably through negotiations.
7.2. Arbitration: If the dispute cannot be resolved through negotiations, the parties may agree on arbitration as a means of dispute resolution.
7.3. Competent court: If arbitration is not possible, the court at the Administrator’s registered office will have jurisdiction.

8. CONFIDENTIALITY AND DATA PROTECTION

8.1. Data protection: The manager is obliged to maintain the confidentiality of all data related to the owner and the property.
8.2. Consent to data processing: The owner gives the manager consent to process personal data for the purpose of implementing the property management contract.

9. GENERAL PROVISIONS

9.1. Changes and additions: All changes or additions to these terms and conditions must be made in writing and agreed by both parties.
9.2. Applicable law: All relations arising from this contract are subject to the applicable law of the country in which the property is located.
